Autoserve Club Membership Terms & Conditions
AUTOSERVE CLUB MEMBERSHIP TERMS AND CONDITIONS
This Autoserve Club Membership Agreement between Autoserve Club Ltd whose office is at St Kenelm court, Steelpark Road, Halesowen, B62 8HD and the person completing this website form hereinafter called ‘Member’.
- DEFINITIONS
a) “AUTOSERVE CLUB” shall mean Autoserve Club Limited and the internet website www.autoserveclub.co.uk
b) “Member” shall mean the person or company detailed in the Membership agreement.
c) An Autoserve Club Membership shall be provided for each completed person who successfully completes, submits and payment is successful.
d) “Vehicle” shall mean a passenger motor vehicle or light commercial vehicle, (including any extras as described).
e) “Agent” shall mean a retailer of supplies or services that participates in the AUTOSERVE CLUB scheme.
- MEMBERSHIP
a) Membership shall be provided for each completed person who successfully completes, submits and payment is successful. Members will be required to log into the Autoserve Club website to access any offers with the username and password they inputted during the sign up process.
b) MEMBERS will have access to motoring, travel and lifestyle deals and discounts from agents appointed by AUTOSERVE CLUB. AUTOSERVE CLUB may receive a rebate based on MEMBERS purchasing from appointed agents. Details in regards to rebate rates and amounts will not be released to MEMBERS.
c) The vehicle registration inputted into the sign up form is the only vehicle the MEMBER can access MEMBER BENEFITS on. This includes but not limited to discounted servicing, 24hr driver helpline, accident management and legal assistance. If a MEMBER changes their vehicle they must inform AUTOSERVE CLUB at their earlier convenience. AUTOSERVE CLUB reserve the right to reject MEMBER BENEFITS based on incorrect or changed vehicle registrations or if the MEMBER is requesting to change the vehicle registration to unfaithfully benefit from deals and discounts.
d) One vehicle per membership. If a MEMBER wishes to cover more than one vehicle they will be required to create multiple accounts to cover each different vehicle.
e) MEMBERS who are issued with a Driver Card they must notify AUTOSERVE CLUB in writing of any lost or stolen cards. Not all MEMBERS will be issued with a Driver Card.
f) If the MEMBER has opted to receive offer emails, emails will be sent on a regular basis reminding members of the discounted offers available and alerting them to recently added offers.
g) There are two membership levels; STANDARD and BUSINESS CLUB.
- STANDARD MEMBERSHIP
i) Standard membership entitles the MEMBER to;
ii) Full access to AUTOSERVE CLUB offers; apart from Duty of Care.
- BUSINESS CLUB MEMBERSHIP
i) Exclusively for Businesses. The business will sign up their employees.
ii) Employees that the business have signed up will have full access to the AUTOSERVE CLUB
offers.
iii) The business will have access to Autoserve’s Duty of Care facility if they wish.
- OFFERS, DEALS AND BENEFITS
a) Members are entitled to access AUTOSERVE CLUB’S range of member benefits. Information on these where the Agent is AUTOSERVE is outlined below.
24 HOUR DRIVER ASSISTANCE
MEMBERS who have signed up to the Premium level Membership are entitled to full use of the 24 hr driver helpline. The MEMBER is required to call AUTOSERVE on 0121 521 3500 and quote their vehicle registration that they have signed up with. Assistance and/or guidance will then be provided by the call operator free of charge. Any required work is the full responsibility of the vehicle driver/owner and not to AUTOSERVE or AUTOSERVE CLUB.
DISCOUNTED SERVICING
a) In order to access AUTOSERVE CLUB’S discounted servicing offer, MEMBERS must contact AUTOSERVE by calling 0121 521 3500 and requesting to book their vehicle in for a service. AUTOSERVE will then book the vehicle into an approved garage for the discounted service at a time and date convenient for the MEMBER.
b) MEMBERS are required to pay the garage directly on collection of the vehicle. Service appointments are to be made during working hours.
c) All work that is carried out through AUTOSERVE carries a full 12 month guarantee on all parts and labour and all garages are trusted and approved. Any technical query with regards to service levels, spare parts or workmanship should be reported to Autoserve Club on 0121 521 3500 or emailed to info@autoserveclub.co.uk. Work carried out by Agents complies with manufacturers warranties and in no way invalidates motor manufacturers warranties.
All other member benefits are provided by agents independent of AUTOSERVE and AUTOSERVE CLUB. For these T&Cs please contact each agent individually, each agent’s name is visible on their offer page.
- PAYMENT
a) The MEMBER shall pay his membership fee via autoserveclub.co.uk, which is facilitated by PayPal in order to enjoy the benefits of club membership. All Member Benefits and access to the offers will be cancelled and deemed invalid on non payment.
b) All offers are paid by the MEMBER direct to the Agent, who is supplying the offer, unless otherwise stated.
c) AUTOSERVE CLUB reserves the right to change the Membership Charge only if during the period an amount that could not have been reasonably anticipated or changes which are beyond AUTOSERVE CLUB’s control.
- TERMINATION OF AUTOSERVE CLUB MEMBERSHIP
a) If a MEMBER wishes to terminate their membership they must request this by emailing info@autoserveclub.co.uk and expressing their wish to terminate their membership. After a members termination request has been processed, their user and therefore access to the Autoserve Club offers will be suspended and/or deleted. If in the future a member wishes to re-start their club membership they will be required to create a new user at the prices specified on the website at the time, no previous discounts will be honoured.
MONTHLY PAYMENT SCHEDULE
If a member wishes to terminate their monthly membership within the first month, the first month is non-refundable. All further monthly payments will be cancelled.
If a member wishes to terminate their contract after the first month, no refunds on previous monthly payments will be given. All further monthly payments will be cancelled unless the member has accessed any offers supplied by Autoserve including but not limited to, the 24hr driver helpline, discounted servicing and the premium managed service. If a member has accessed these offers and/or services each termination request will be reviewed on a case-by-case basis and may by be subject to final payments. This is based upon each individual case and is the discretion of Autoserve Club Ltd to whether or not issue a full or partial refund. Autoserve Club’s decision is final and no further conversation will be entered into.
QUARTERLY PAYMENT SCHEDULE
If a member wishes to terminate their quarterly membership within the first quarter (the first 4 months to which the quarter refers to), the first quarter is non-refundable. All further quarterly payments will be cancelled.
If a member wishes to terminate their contract after the first full quarter, partial refunds may be considered if requested. All further quarterly payments will be cancelled.
If requested, a partial refund may be given unless the member has accessed any offers supplied by Autoserve including but not limited to, the 24hr driver helpline, discounted servicing and the premium managed service. If a member has accessed these offers and/or services each termination request will be reviewed on a case-by-case basis and may by be subject to final payments and/or a partial refund may be not awarded. This is based upon each individual case and is the discretion of Autoserve Club Ltd to whether or not issue a full or partial refund. Autoserve Club’s decision is final and no further conversation will be entered into.
ANNUAL PAYMENT SCHEDULE
Any annual payments that are over £42 are subject to a 14 day cooling off period in line with UK law. If you request to cancel within your 14 day cooling off period a refund will be issued in full. You must email info@autoserveclub.co.uk to request to cancel. After the 14 day cooling-off period has expired, the below rights to cancel and termination process will apply.
If a member wishes to terminate their annual membership within the first year (the first 12 months to which the year refers to) all further annual payments will be cancelled.
If requested, a partial refund may be given unless the member has accessed any offers supplied by Autoserve including but not limited to, the 24hr driver helpline, discounted servicing and the premium managed service. If a member has accessed these offers and/or services each termination request will be reviewed on a case-by-case basis and may by be subject to final payments and/or a partial refund may be not awarded. This is based upon each individual case and is the discretion of Autoserve Club Ltd to whether or not issue a full or partial refund. Autoserve Club’s decision is final and no further conversation will be entered into.
- INDEMNITY
a) The Member shall indemnify AUTOSERVE CLUB against all claims, liabilities, losses, damages or expenses, including legal fees, and any liability resulting from legislation for the payment of fines or penalties for parking, driving or similar offences incurred by AUTOSERVE CLUB relating to the vehicles. The Member shall be entitled to the benefit of any conditions and/or warranties which may have been given by the manufacturer and/or agent only in so far as they may be transferred by AUTOSERVE CLUB. It is understood by the directors authorising this agreement that should the company fail in any way to pay all charges incurred by the use of the Autoserve Club fleet services a personal guarantee will unconditionally guarantee each and every one of the debtor’s obligations without limit of all payments and obligations due on this agreement. This is not a continuing guarantee and will only be in force for the term of this agreement and no other past or present.
- DEFAULT
a) AUTOSERVE CLUB may forthwith by notice in writing to the Member terminate all rights of the Member under this agreement and in respect of all users if the Member shall: –
i.) Become insolvent, make any composition, enter into any deed of arrangement with its creditors, become bankrupt whether voluntary or compulsory.
ii.) Fail to observe and perform any provision or obligation of this agreement, including failure to pay charges.
iii.) Default or an event of default has occurred under any agreement between (1) AUTOSERVE CLUB and its associated or subsidiary companies and (2) the Member or; (i) Default or an event of default has occurred under any terms, provisions or condition of any agreement or instrument evidencing or governing debt of the Member and/or its subsidiary/associated companies, or under any agreement relating thereto, the effect of which is to cause, or permit the holder or holders thereof, or a trustee or agent on behalf of such holder or holders, to cause such debt to become due and payable prior to its stated maturity or otherwise when due. In this clause “debt” means the Members and/or its subsidiary/associated companies (i) obligations for borrowed money, (ii) obligations representing the deferred purchase price of property other than accounts payable arising in the ordinary course of the Member’s and/or it’s subsidiary/associated companies business on terms customary in the trade, (iii) obligations, whether or not assumed, secured by liens or payable out of the proceeds or production from property now or hereafter owned or acquired by the Member and/or it’s subsidiary/associated companies, (iv) obligations which are evidenced by notices, acceptances, or other instruments, (v) capitalised lease obligations and (vi) obligations for which the Member and/or its subsidiary/associated companies is obligated pursuant to any guarantee, indemnity or other contingent undertaking.
- b) However, AUTOSERVE CLUB may elect to treat default by the Member on any of the matters referred to above in any single vehicle as termination of the Contract Term in respect of that vehicle in which the provisions of Clause 14 will apply to that vehicle.
- CONFIDENTIALITY
Neither party will disclose to any third party except as required by statute, regulatory agency ruling or court order any information, facts, date or trade secrets of any kind or nature whatsoever which relate to the business of the other of which such party or any of its agents or employees may gain knowledge through the relationship contemplated by, and whether before, during the term of, or after the date of this agreement other than any information, facts, data or trade secrets which are in the public domain or which were known to the parties (other than those disclosed during the course of the negotiations hereof) prior to the date of this agreement.
